OPRAVdu KAFE

Terms and Conditions

The rules for buying in our shop: how an order is made, how you pay and receive goods, how to withdraw from the contract and how to make a complaint.

Effective from 12 October 2026

These terms and conditions govern purchases in the online shop at www.opravdukafe.cz operated by MPV Novotní s.r.o., Company ID 05737052, registered office Vrchní 280, 747 31 Chlebičov, Czech Republic, registered in the Commercial Register kept by the Regional Court in Ostrava, Section C, Insert 69095 (the "Seller"). Contact: servis@opravdukafe.cz, phone +420 792 312 852, premises Jeremenkova 485/13, 703 00 Ostrava 3, Czech Republic. The Czech version of these terms is the binding one; this translation is provided for convenience.

1. Introductory provisions

These terms set out the rights and obligations of the Seller and the buyer when concluding a purchase contract through the online shop. The buyer is either a consumer (a person buying outside their business activity) or a business. Provisions intended for consumers do not apply to businesses where their nature so implies.

The terms form an integral part of the purchase contract. The contract and the terms are drawn up in Czech and are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection.

The Seller may amend these terms. The version in force at the moment an order is placed applies to that order.

2. Conclusion of the contract

The presentation of goods in the shop is for information only and the Seller is not obliged to conclude a contract for these goods.

The buyer places an order by adding goods to the cart, filling in contact and delivery details, choosing shipping and payment, and clicking "Order with obligation to pay". Before submitting, the buyer can review and change the details. By placing the order the buyer confirms that they have read and agree to these terms.

After receiving the order the Seller sends a confirmation to the buyer's e-mail. The contract is concluded upon delivery of this confirmation, which contains the order summary and payment details, with these terms and the model withdrawal form attached as PDF.

Prices are stated in Czech crowns (CZK) including VAT; the Seller is VAT registered, VAT ID CZ05737052. Shipping costs according to the chosen method (see Article 4) are added. In case of an obvious pricing error the Seller will inform the buyer without delay and either party may withdraw from the contract.

The Seller may cancel an order or withdraw from the contract if the goods are unavailable or sold out, or in case of an obvious pricing error. The buyer will be informed without delay and any payment already made will be refunded.

3. Price and payment

The buyer can pay the purchase price and shipping in the following ways:

  • by bank transfer to the Seller's account – payment details (account number, variable symbol = order number, amount) are shown after the order is placed and included in the confirmation e-mail,
  • online by payment card or bank button (instant transfer from internet banking) through the Comgate payment gateway – after placing the order the buyer is redirected to the secure gateway,
  • in cash or by card at the Seller's premises, for pickup orders only.

Online payments are provided by the Comgate payment gateway. The provider, Comgate, a.s., is a licensed payment institution supervised by the Czech National Bank. Payments made through the gateway are fully secured and all information is encrypted; the Seller never receives or stores card details. Complaints and questions about online payments may also be raised directly with Comgate, a.s., Gočárova třída 1754/48b, Hradec Králové, Czech Republic, e-mail podpora@comgate.cz, phone +420 228 224 267. More information at www.comgate.eu.

When paying by bank transfer, the price is due within 5 business days of concluding the contract. If it is not credited within that period, the Seller may cancel the order. Goods are shipped or prepared for pickup only after the payment has been received; when paying at the premises, the buyer pays on collection.

The Seller issues an invoice for each order and sends it electronically to the buyer's e-mail or hands it over at pickup.

4. Delivery

The buyer chooses one of the following delivery methods:

  • PPL courier to an address in the Czech Republic, CZK 119,
  • DPD courier to an address in the Czech Republic, CZK 119,
  • pickup at our premises, Jeremenkova 485/13, 703 00 Ostrava 3, Czech Republic, free of charge, during the opening hours published on the website.

Goods in stock are usually dispatched within 3 business days after the payment is received; for coffee machines and goods not in stock the delivery date is agreed individually and communicated by e-mail or phone. Goods for pickup are reserved for 14 days after the buyer is notified that they are ready.

The Seller delivers only within the Czech Republic. Delivery abroad is possible by individual arrangement only.

The buyer should inspect the goods on receipt. If the packaging is damaged, we recommend refusing the parcel or drawing up a damage report with the carrier and informing the Seller immediately.

If the buyer fails to collect the goods without a legitimate reason, the Seller may claim reimbursement of shipping and storage costs and withdraw from the contract.

5. Withdrawal from the contract (consumers)

A consumer may withdraw from the contract without giving a reason within 14 days of receiving the goods (for split deliveries, from receipt of the last part). It is sufficient to send the withdrawal within this period.

The withdrawal may be sent by e-mail to servis@opravdukafe.cz or in writing to Jeremenkova 485/13, 703 00 Ostrava 3, Czech Republic. The buyer may use the model withdrawal form annexed to these terms (also attached to the order confirmation) or any other wording identifying the order number, the buyer's name and address, and the date. The Seller confirms receipt by e-mail.

The buyer returns the goods within 14 days of withdrawal, unused, undamaged and preferably in the original packaging, including accessories and documents. The cost of returning the goods is borne by the buyer. The goods may be sent (by post or courier) or handed over at our premises.

The Seller refunds all payments received, including the cheapest offered delivery cost, within 14 days of withdrawal, but not before receiving the goods back or proof of their dispatch. Refunds are made the same way the payment was received (to the account the transfer came from, or back to the card or account used for an online payment) unless agreed otherwise.

The buyer is liable for any reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Under Section 1837 of the Civil Code, withdrawal is not possible for goods in sealed packaging which are not suitable for return for health or hygiene reasons once the seal has been broken. This applies in particular to coffee whose original packaging has been opened and to cleaning chemistry (descalers, cleaning tablets) with broken packaging.

This Article does not apply to buyers purchasing in the course of their business.

6. Defective performance and complaints

The Seller is liable to the buyer for the goods being free of defects on receipt, in particular that they correspond to the agreed description, type, quantity, quality and functionality and are fit for their usual purpose.

A consumer may complain about a defect that appears within 2 years of receipt. Goods with a best-before date (coffee, chemistry) may be claimed until that date. A defect that appears within 1 year of receipt is presumed to have existed on receipt.

Complaints may be made by e-mail to servis@opravdukafe.cz, by phone on +420 792 312 852 or in person at Jeremenkova 485/13, 703 00 Ostrava 3, Czech Republic. Please state the order number, describe the defect and your preferred remedy, and hand over or send the goods to the Seller. The Seller issues a written confirmation stating when the complaint was made, its content and the remedy requested, and after settling it a confirmation of the date and method of settlement, including confirmation of any repair and its duration, or a written justification if the complaint is rejected.

If the goods are defective, the buyer may request removal of the defect by delivery of a new item or by repair, unless the chosen method is impossible or disproportionately costly. The buyer may request a reasonable discount or withdraw from the contract if the Seller refused to remove the defect or did not remove it within a reasonable time, the defect recurs, the defect is a material breach of contract, or it is evident that the defect will not be removed within a reasonable time or without considerable difficulty. Withdrawal is not possible for an insignificant defect.

The Seller settles the complaint, including removal of the defect, within 30 days of its submission unless a longer period is agreed. If the complaint is justified, the buyer is entitled to reimbursement of reasonable costs incurred.

Rights from defective performance do not cover defects caused by normal wear, misuse, neglected maintenance (e.g. failure to descale a coffee machine), mechanical damage or third-party intervention. Manufacturers' warranties on coffee machines are governed by their own warranty terms.

For business buyers the period for notifying defects is 12 months from receipt and consumer provisions do not apply.

7. Take-back of electrical equipment

Coffee machines and other electrical equipment must not be disposed of with household waste – they are marked with the crossed-out wheelie bin symbol. Old equipment can be handed in free of charge at municipal collection yards and other take-back points for recycling.

When buying new electrical equipment from the Seller, the buyer may return old equipment of the same type and purpose free of charge (one for one) at our premises, Jeremenkova 485/13, 703 00 Ostrava 3, Czech Republic, during opening hours. For courier deliveries, the buyer agrees this in advance by e-mail at servis@opravdukafe.cz or phone +420 792 312 852 and the Seller arranges the collection.

8. Personal data

Information on what personal data the Seller processes, why, and what rights the buyer has, is set out in the separate Privacy Policy at www.opravdukafe.cz/en/privacy-policy.

9. Out-of-court dispute resolution

The body competent for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, e-mail adr@coi.cz, web adr.coi.cz.

Complaints may also be addressed directly to the Seller at servis@opravdukafe.cz.

10. Final provisions

The Seller is not bound by any codes of conduct within the meaning of Section 1826(1)(e) of the Civil Code.

If any provision of these terms is invalid or ineffective, a provision whose meaning is closest to it applies; the remaining provisions are unaffected.

The contract, including these terms, is archived by the Seller in electronic form and is not accessible to third parties. The buyer receives its content in the confirmation e-mail, with these terms attached as PDF.

The model withdrawal form is annexed to these terms.
